These Terms & Conditions (“Terms”) govern all photo and/or video package purchases made through Anything For Sports (“AFS”, “we”, “us”, or “our”) for the 18th Annual Red, White, and Blue ISI Open Championships (the “Event”). By submitting payment, you (“Client”, “you”, or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Definitions
Deliverables – The digital photographs and/or video files produced by AFS for the Client.
Performance – An individual skating routine listed on the official Event schedule.
2. Purchase & Payment
- Full payment is due at the time the order is placed. Orders will not be processed without successful payment confirmation.
- Pricing is posted on the order form. Early‑bird promotional pricing applies only to purchases completed before 12:00 p.m. (noon) on July 6 2025.
3. Deliverables
- Photos – Minimum 20 professionally edited, full‑resolution JPEG images per Performance, captured on Sony α9 II cameras and color‑graded by the AFS editing team.
- Videos – One 4K 60 fps UHD video file per Performance, delivered via a download link and an unlisted YouTube link for personal sharing.
- Delivery window: 48 – 72 hours after the final day of recording.
4. Refund Policy
- All sales are final once Deliverables have been provided. No refunds, charge‑backs, or credits will be issued after files are delivered.
- If AFS fails to capture an Event Performance for which you prepaid, a full refund for that missed Performance will be processed to the original payment method within 7 business days.
5. Production Limitations
- Filming and photography are performed from the designated media zone at rink‑side. A small blind spot exists near the entry/exit gate; brief moments occurring in this zone may not be recorded. By purchasing, you acknowledge and accept this limitation.
- Lighting, audience movement, venue restrictions, and other uncontrollable factors can affect final output. AFS will make reasonable efforts to produce high‑quality media but does not guarantee any specific shot, angle, or duration.
6. License & Usage
- Upon full payment, AFS grants the Client a non‑exclusive, perpetual license for personal use, sharing with friends and family, and posting to social media.
- Commercial use, redistribution, resale, or alteration beyond basic cropping/filters requires prior written consent from AFS and may incur additional licensing fees.
7. Intellectual Property
- All original raw footage, photographs, and edits remain the exclusive property of AFS.
- AFS reserves the right to showcase Deliverables for self‑promotion (website, portfolios, social media, advertising) unless the Client opts out in writing at the time of purchase.
8. Limitation of Liability & Indemnity
- AFS’s total liability for any claim arising under these Terms shall not exceed the amount paid by the Client for the affected Deliverables.
- Client agrees to indemnify and hold harmless AFS and its personnel against claims, damages, or expenses arising from Client’s misuse of the Deliverables or breach of these Terms.
9. Force Majeure
AFS is not liable for delays or failures caused by events beyond its reasonable control, including but not limited to equipment failure, acts of God, illness, venue policy changes, or power outages. In such cases AFS will, where feasible, offer rescheduling or a pro‑rata refund.
10. Data Privacy
AFS collects only the personal information necessary to process orders and deliver media. We do not sell or share your data with third parties except payment processors and delivery platforms required to fulfill your order. See afsprivacy.org for our full Privacy Policy.
11. Governing Law
These Terms are governed by and construed under the laws of the State of Nevada, without regard to conflict of law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Clark County, Nevada.
12. Acceptance
By checking the acceptance box and submitting payment, you confirm that you are at least 18 years old and agree to these Terms & Conditions in full.
